Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the NextDevKit service (the "Service") operated by NextDevKit ("us", "we", or "our").

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2.1 Account Creation

3. Subscriptions and Payments

3.1 Billing Cycle

  • The Service is billed on a subscription basis ("Subscription").
  • You will be billed in advance on a recurring and periodic basis ("Billing Cycle").
  • Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select.

3.2 Payment Methods

  • A valid payment method, including credit card or PayPal, is required to process the payment for your Subscription.
  • You shall provide accurate and complete billing information including full name, address, state, zip code, telephone number, and valid payment method information.

3.3 Price Changes

  • We reserve the right to modify the Subscription fees for the Subscriptions at any time.
  • Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
  • We will provide you with reasonable prior notice of any change in Subscription fees.
  • Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified fee.

4. Free Trial

  • We may offer a free trial to new users.
  • At any time and without notice, we reserve the right to modify the terms of the free trial, or cancel the free trial offer.
  • At the end of the free trial period, we will automatically start billing for your chosen subscription unless you cancel before the trial ends.

5. Cancellation and Refunds

5.1 Cancellation

  • You may cancel your Subscription at any time through your account settings or by contacting us.
  • Your subscription will remain active until the end of your current billing period.
  • Upon cancellation, you will continue to have access to the Service until the end of your current paid period.

5.2 Refunds

  • Subscription fees are generally non-refundable.
  • We may consider refund requests on a case-by-case basis at our sole discretion.
  • Any approved refunds will be processed within 5-10 business days.

6. Service Availability

6.1 Uptime

  • We strive to maintain 99.9% service uptime.
  • We do not guarantee that the Service will be available at all times.
  • We may experience hardware, software, or other problems that result in service interruptions.

6.2 Maintenance

  • We reserve the right to perform scheduled maintenance.
  • We will provide advance notice of scheduled maintenance when possible.

7. Intellectual Property

  • The Service and its original content, features, and functionality are owned by NextDevKit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
  • Our trademarks and trade dress may not be used without our prior written consent.

8. User Content

8.1 Ownership

  • You retain ownership of any content you submit, post, or display on or through the Service ("User Content").
  • By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, and display such content in connection with the Service.

8.2 Restrictions

You agree not to upload, post, or transmit any content that:

  • Is unlawful, harmful, threatening, abusive, or defamatory
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
  • Contains software viruses or any other harmful code

9. Limitation of Liability

In no event shall NextDevKit, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last updated" date.
